� o� <br /> 0 0 <br /> C ITY of ORONO <br /> a .; � <br /> ti <br /> ti <br /> RESOLUTION OF THE CITY COUNCIL <br /> ��`�k'EsKo�`'�G No. 5 7 3 4 <br /> A RESOLUTION GRANTING VARIANCES <br /> TO MUNICIPAL ZONING CODE <br /> SECTION 78-305 <br /> FILE NO. 08-3343 <br /> WHEREAS, Strong Arm Construction Services, LLC, a Minnesota limited <br /> liability corporation (hereinafter"Owner") is the owner of the property located at 460 East <br /> Long Lake Road within the City of Orono (hereinafter "City") and legally described as: See <br /> Exhibit A (hereinafter "the Property"); and <br /> WHEREAS, Strong Arm Construction Services, LLC has made application on <br /> behalf of the Owner to the City for a variance to Municipal Zoning Code Section 78-305 to <br /> construct a house on the Property which has a defined lot area of 0.59 acre when two acres is <br /> required; and <br /> WHEREAS, Strong Arm Construction Services, LLC has made application on <br /> behalf of the Owner to the City for variances to Municipal Zoning Code Section 78-305 to <br /> construct this house with a 43-foot front setback when a 50-foot setback is required and a 10- <br /> foot south side setback when a 30-foot setback is required; and <br /> WHEREAS, after due published notice and mailed notice in accordance with <br /> Minnesota Statutes and the City of Orono Zoning and Planning Codes, the Orono Planning <br /> Commission held a public hearing on February 19, 2008, at which times all persons desiring <br /> to be heard concerning this application were given the opportunity to speak thereon. <br /> NOW, THEREFORE, BE IT RESOLVED by the City Council of Orono, <br /> Minnesota: <br /> FINDINGS <br /> l. This application was reviewed as Zoning File#08-3343. <br /> 2. The Property is located in the LR-lA zoning district, where two acres is the <br /> minimum lot area and 200 feet is the minimum lot width. The Property is <br /> approximately 0.84 acre (0.59 acre non-wetland)in area and 203 feet in width. <br /> 3. The Planning Commission reviewed this application on February 19, 2008 and <br /> Page 1 of 5 <br />
