Strong Arm Construction built a <br /> new home on the property, entered into a wetland buffer maintenance agreement and granted a <br /> Permanent F/owage and Conservation Easement and Restrictive Covenant for Wetland and Wetland <br /> Buffer (copy attached). Strong Arm Construction paid a $2,000 escrow to ensure the wetland buffer <br /> was established per the requirements. <br /> Recently, John Symth, (the City's wetland specialist with Bonestroo) acting as an agent for the City, <br /> conducted a wetland buffer compliance inspection at your property and discovered that the wetland <br /> buffer improvements required as part of the new home construction had not been completed, see <br /> Smyth's memo attached. <br /> In order to bring the property into compliance with the wetland buffer requirements, the play structure <br /> must be move out of the buffer, all buckthorn must be removed and the soil properly prepared for re- <br /> vegetation according to approved plan provided by Loucks Associates or with the seed mix according � <br /> to City Code 78-1605(3). <br /> Please submit your plan to bring the property into compliance by September 6, 2011. Upon <br /> compliance of the wetland buffer requirements, the $2,000 escrow, which the City holds, will be <br /> refunded to you. <br /> I understand this information may be unexpected and I encourage you to contact me with questions.
