Our initial site plan review indicates the following <br /> issues that must be resolved in order for the application review to proceed: <br /> 1. Wetland Crossing. The proposed driveway crossing of the wetland and wetland buffer <br /> cannot be approved, as these areas are protected via City ordinance and the Mooney Lake <br /> Preserve development covenants. <br /> 2. Driveway Relocation. Additionally, per City Code, any driveway location that is within <br /> 35 feet of the wetland boundary ar within 10 feet of the septic system soil treatment area <br /> cannot be approved. It would appear that the only feasible driveway location will be <br /> easterly and southerly of the proposed septic areas as depicted on the submitted survey. <br /> Any driveway proposed in this area must be designed to have no impact on the tree buffer <br /> required by the development approvals along the southeast border of this property. <br /> Alternatively, if it is feasible to shift the septic sites further east, a driveway might be <br /> located between the wetland and the septic sites; this will require analysis and approval <br /> from your ISTS Site Evaluator/Designer. <br /> 3. Excavation for Walkout—CUP Required. The proposed excavation to create a rear <br /> walkout configuration is estimated at 5,000-6,000 cubic yards, and requires a Conditional <br /> Use Permit(CUP) because it exceeds the 500 cubic yard threshold allowed for the normal <br /> and customary grading in the area of a proposed house, per Orono Zoning Code Sections <br /> 78-966 thru 78-968. The CUP application process typically takes approximately 60 days <br /> from the date of submittal of a complete application, and there is no guarantee of <br /> approval. <br /> 4. Potential Wetland Impact. The proposed rear walkout excavation has the potential to <br /> have a negative impact on the wetland at the northeast corner of the property, because the <br /> wetland is at approximately the 1016' elevation and the proposed excavation within 50- <br /> 80 feet of the wetland is as much as 8 feet lower than the wetland elevation. This has the <br /> potential to result in draining of that wetland which would be prohibited. <br />
