Co,u rrahc--�' — r�-n�. 23 Cs� <br /> Plans B and D, fhe proposed grAding plan contours shall become the new existing grade for <br /> determinations of number of stories and building height. <br /> R The Developer shall provide information to the initial buyers of each lot <br /> regarding the allowed uses within the designated Preservation Areas and regarding the necessity <br /> of preserving alternate mound drainfield sites, by recording the Declaration described as Plan I in <br /> Section 7 above. <br /> S. Plans B and C depict the potential location of a rain garden on each of Lots <br /> 1,2, 3, 5, G and 7,Block l,and Lots 1,2 and 3,Block Z, which rain gardens are required as part <br /> of the overall stormwater drainage system for the Project. No rain garden shall be required on <br /> Lots 4 and 8, Block 1. The City shall not be obligated to issue a Certificate of Occupancy for a <br /> dwelling constructed on any of Lots 1,2, 3, 5,6 or 7, Block 1,or Lots 1,2 or 3, Block 2,until the <br /> City Engineer has Approved, based on the location and dimensions of the dwelling and other <br /> improvements to be constructed on the lot, the location and dimensions of the rain garden to be <br /> created on such lot, and unril the owner of the lot has caused to be duly recorded in the office of <br /> said Registrar of Titles an easement in favor of the City, substantially in the form attached hereto <br /> as EXffiBIT B, encumbering the approved area of the rain garden on the lot. The recording of <br /> such easement shall be conclusive evidence of compliance by such owner with this Subsection <br /> 23S if the recorded easement includes the written approval of the City Engineer. <br /> 24. SUMMARY OF SECURITY REQUIREMENTS. To guarantee compliance <br /> with the terms of this Contract and construcrion and payment of the costs of all Iinprovements,the <br /> Developer shall fizmish the City,prior to the City's release of the Plat for recorcling,with cash,or <br /> a letter of credit in the form attached hereto from a bank(the"security") for 150% of the cost of <br /> the Iinprovements.
