MINUTES OF THE <br />ORONO CITY COUNCIL MEETING <br />Monday, November 26, 2007 <br />7:00 o’clock p.m. <br />___________________________________________________________________________________ <br /> <br />PAGE 29 of 32 <br />(MCES Grant Program For Drain Tile Disconnections, Continued) <br /> <br />option to use that money to do I&I improvements. Disconnecting drain tile from the City sewer system <br />would also qualify as an I&I improvement. Moorse indicated the City would actually be paying a <br />significant share of the costs and then getting reimbursed. The other portion would go toward the <br />surcharge, which would significantly lower the costs to the property owner. <br /> <br />McMillan asked whether the City would be doing the construction work and the billing or how the <br />process is supposed to work. <br /> <br />Moorse stated under the surcharge portion of it, the City would be subcontracting with a contractor, and <br />that he is unsure whether the grant program would cover the costs if a private owner directly contracts <br />with a contractor for the work. <br /> <br />Kellogg stated the I&I issues in Orono are lake related and that what they are attempting to limit are the <br />I&I spikes experienced during a big rain storm event. Kellogg stated connecting the drain tile to the <br />sewer system was once an allowable practice but has since been disallowed. <br /> <br />McMillan moved, Bremer seconded, to adopt RESOLUTION NO. 5698, a Resolution Authorizing <br />Participation in the MCES Foundation Drain Separation Grant Program. VOTE: Ayes 5, Nays 0. <br /> <br /> <br />17. POLICE SERGEANT LABOR AGREEMENT 2008 AND 2009 <br /> <br />Murphy asked whether the Minnesota Supreme Court has recently ruled that vacation time cannot be <br />carried over. <br /> <br />Mattick stated there was a case that was recently decided by the Supreme Court concerning sick time, <br />which raised the issue with vacation time. The Supreme Court has ruled that if the City has in its policy <br />when and under what terms a person accumulates that vacation time, policies defined as use it or lose it <br />are acceptable. <br /> <br /> <br />Item #02 - CC Agenda - 12/10/07 <br />Approval of Council Minutes 11/26/07 [Page 29 of 32]
