VOTE: Ayes 5, Nays 0. <br /> <br /> <br />*5. #07-3259 LAKE COUNTRY BUILDERS ON BEHALF OF KATHY AND GARY <br />GANGSTEE, 1374 REST POINT ROAD – VARIANCE – RESOLUTION NO. 5632 <br /> <br />Murphy moved, McMillan seconded, to adopt RESOLUTION NO. 5632, a Resolution Granting <br />Variances and a Conditional Use Permit and Variance for the property located at 1374 Rest Point <br />Road. VOTE: Ayes 5, Nays 0. <br /> <br /> <br />6. #07-3296 SUZANNE AND TERRY JOHNSON, 543 PARK LANE – VARIANCE – <br />RESOLUTION NO. 5633 <br /> <br />Suzanne Johnson, Applicant, was present. <br /> <br />Bremer stated some members of the Planning Commission had a concern regarding the appearance of the <br />entryway and that the stairs could be redesigned to meet the 10-foot setback. <br /> <br />Curtis stated the applicants’ original survey did not reflect that the front entry stairs had an angled portion <br />which encroached into the side yard. That angled portion results in an 8.3 foot setback where a 10-foot <br />setback is required. <br /> <br />Murphy inquired whether this application was before the City Council previously. <br /> <br />Curtis stated this application as it relates to the overhangs was discussed during the public comment <br />portion of a previous City Council meeting. Curtis stated the overhang had been included on the <br />applicants’ plans the entire time but that City Staff did not catch it at the time it was before the Planning <br />Commission. The overhang encroachment was noticed at the time the applicants applied for their <br />building permit. <br /> <br />Bremer stated if the entry came off the side rather than the front, they would be allowed to have a larger <br />entryway. <br /> <br /> <br />PAGE 3 of 6 <br />Item #02 - CC Agenda - 07/09/07 <br />Approval of Council Minutes 07/25/07 [Page 3 of 6]
