, .� �; . • , <br /> CITY/CONTRACTOR WORK AGREEMENT <br /> THIS AGREEMENT ("Agreement") is made this day of May, 2011, by and between the <br /> City of Orono, a Minnesota Municipal Corporation(the"City") and Farr Construction(the <br /> "Contractor"). <br /> In consideration of the mutual covenants and promises contained in this Agreement,the City and <br /> the Contractor agree as follows: <br /> 1. General Conditions. Contractor sha11 perform the work described by this Agreement <br /> and the Specifications as set forth in Exhibit A attached hereto (the"Work"); and any written <br /> Change Orders executed by the City and the Contractor. <br /> 2. Work to be Completed. Contractor shall provide all labor and materials necessary to <br /> complete the Work for the demolition of buildings (the "Demolition") and the proper removal <br /> and disposal of all demolition material,junk, refuse and debris from 1200 Hollander Road, � <br /> Orono, Minnesota(the "Property"). <br /> 3. Commencement and Comuletion of Work. The Work shall commence only after <br /> removal of all regulated waste is performed by the regulated waste contractor and the Contractor <br /> is provided by the Gity with a written"Notice to Proceed". <br /> 4. Disposal of All Demolition Material. Contractor shall comply with a11 applicable laws, <br /> rules and regulations regarding the disposal of all demolition material,junk, refuse and debris <br /> from the Property. <br /> 5. Pavment. The Work including all labor, materials, and equipment needed to accomplish <br /> the same, shall be completed by the Contractor for the sum of Twenty-Two Thousand'Three <br /> Hundred and no/100ths Dollars ($22,300.00) (the "Contract Price")to be paid to the Contractor <br /> in one installment upon completion of the Work to the satisfaction of the City. The Contractor <br /> agrees to furnish the City with all Mechanics Lien Waivers and evidence of the proper disposal <br /> of a11 demolition material,junk,refuse and debris deemed necessary by the City, prior to full <br /> payment of the Contract Price. The Contract Price sha11 constitute the sole compensation <br /> payable to the Contractor for completion of the Work. <br /> 6. Storage and Protection. Contractor shall be responsible for the storage and protection of <br /> all equipment and materials to be supplied under the terms of this Agreement until the Work is <br /> complete and the City has accepted the Work. <br /> 7. Clean-up. Contractor shall maintain an orderly and clean work site, and shall daily <br /> remove and properly dispose of all waste, and debris resulting from performance under this <br /> Agreement. <br /> 1 <br /> 157477 <br />
