MINUTES OF THE <br />ORONO CITY COUNCIL MEETING <br />Monday, April 23, 2007 <br />7:00 o’clock p.m. <br />___________________________________________________________________________________ <br /> <br />7. #07-3272 KERN HOPPE, 1150 WYNDMERE ROAD – SUBDIVISION/PRELIMINARY <br />PLAT <br />Kern Hoppe, Applicant, was present. <br />Turner stated the applicant is requesting preliminary plat approval to divide the property into a 3.95 acre <br />lot for the existing house and a 3.62 acre lot for a new house. Hennepin County is requesting an <br />additional ten feet of right-of-way. It has been customary for the City to not honor these requests unless <br />it can be demonstrated that the plat creates the need for the additional right-of-way. <br />The Planning Commission voted 7 to 0 to recommend approval of the preliminary plat subject to: <br />1. A wetland delineation acceptable to the MCWD being provided with the application for final <br />plat approval. <br />2. The Flowage and Conservation Easement being revised as necessary to reflect change in <br />location of the wetland and current regulations. <br />3. The plat providing a drainage easement over the portion of the property with an elevation of <br />969.5 and below. <br />4. Payment of a park dedication fee for the new lot. <br />5. Payment of the storm drainage fee. <br />6. The title opinion required with the application for final plat approval addressing this issue of the <br />new lot having access from Wyndmere Road. Access from Sixth Avenue North is not <br />acceptable as it is a county road. <br />Planning Staff recommends approval of the preliminary plat per the Planning Commission <br />recommendation with the addition to the first condition of the following language: “and both lots <br />having two acres of high, buildable land.” <br />White commented that given the elevation of the land, it does not appear likely that there are extensive <br />wetlands on this property. <br />City Engineer stated he does not know whether a formal review by his office has been completed on this <br />application. <br />Murphy suggested a motion be passed with the stipulation that the wetland delineation be completed <br />prior to any other work being commenced on this project and that the Council would not need to review <br />this application again unless the wetland delineation negatively impacts the buildable area of the two <br />lots. <br /> <br /> <br />PAGE 8 <br />Item #02 - CC Agenda - 05/14/07 <br />Approval of Council Minutes 4/23/07 [Page 8 of 15]
