Type ojdata The rights of individua[on whom the data is stored or to be stored sha11 be as set forth in this section. <br /> Subd 2. Injormation required to be given individunL An indrvidual asked to supp[y prrvate or confidential data concerntng himse f <br /> shall be informed of (a)the purpose and intended use of the requested data within the collecting state agency,political subdivision,or statewide <br /> system;(b)whethes he may refuse or is legally required to supply the requested data;(c)arry known corrsequence arising from his supp[ying or <br /> refusing to supply private or confrdential data;and(d)the identity of other persons or entities authorized by state or federa!law to recerve the data. <br /> Thtt sequirement shal!not apply ivhen an individuctl is asked to supply irrvestigative data,pursuant to section 13.82, subdivision S, to a law <br /> enforcement o�cer. <br /> The commissioner of revenue mav place the notice reouired under this subdivrsion in the individua[income tax or nronertv tax refund <br /> instructiorrs instead ot on those forms. <br /> Subd.3. Access to data by individuaL Upon request to a responsible authority,an individual shall be informed whether he is the subject <br /> of stored data on individuals,and whether rt rs classrfred as public,private or confidential. Upon his further�equest,an individual who is the <br /> subject of stored private or pub/ic data on rndividuals shal!be shown the data withou�a�ry charge to him and,if he desires,shall be informed of <br /> the content and meaning o,jthat data After an individua!has been shown the private data and infornred of rts meaxing,the data need not be <br /> disclosed to htm for six months thereafler unless a dispute or action pursuant to this sectron is pending or additional data on the individua!has <br /> been co!/ected or created. The responsrble authority shal[provide copies of the private or public data upon request by the individual subject of <br /> the data. The responsible authority may require the reqt�estrng person to pay the actua[cosu of making,cert�rng,and compiling the copies. <br /> The responsible authority shall comply immediately,if possible,with arry request made pursuant to this subdivision,or within five days <br /> ojthe date of the request,excluding Saturdays,Sundays and legal holidays,if immediate compliance is not possib[e. If he cannot comply with the <br /> request within that time,he shall so in,jorm the individual,and may have an additional frve days within which to comply with the request,excluding <br /> Saturdays,Sundays arrd lega!holidays. <br /> Subd.4. Procedure when data is not accurate or complete An individual may contest the accuracy or cornpleteness ofpublic or private <br /> data concerning himselJ. To exercise this right, an individual shall nat�in wsiting the resporrsible authority descrrbing the nature of the <br /> disagreernent. The responsible authorily shall wr[hin 30 days either: (a)correct the data found to be inaccurate or rncomplete and attempt to not� <br /> past recipients ojrnaccurate or incomplete data,includrng reciprents named by�he indivrdual;or(b)not�the individual that he belreves the data <br /> to be correcl.
