Council approvai is based on the survey and plans submitted by the Owners and annotated by City staff, attached to this Resolution as Exhibits A & B. Any amendments to the approved plans which are not in conformity with City codes will require further Planning Commission and City Council review. 2. Proposed overall hardcover levels shall conform to the Tier 1 standards. 3. The Owners shall keep debris off of the public roadways. The noise resulting from the trucks and equipment moving the material in and around the site shall be minimized to the extent possible. The grading project will be evaluated and monitored by the City Engineer, Minnehaha Creek Watershed District and planning staff so as to minimize nuisances during the project. 4. Compliance with all permitting requirements of the Minnehaha Creek Watershed District. 5. Compliance with ongoing rec:flmmendations of the City Engineer. 6. Authorities granted by this resolution run with the Property not with the Owners, but are permissive only and must be exercised by obtaining permits and commencing construction of said project within one year of the date of Council approval, or the approvals granted by this Resolution will expire on that date(October 12, 2016). 7. An as-built survey will be required upon completion of the project prior to refund of the administrative grading and building permit escrows. 8. Violation of or non-compliance with any of the terms and conditions of this resolution shall constitute a violation of the zoning code, shall automatically terminate any authority granted herein, and shall be punishable as a misdemeanor. 9. The undersigned Owners have read, understand and hereby agree to the terms of this resolution and on behalf of the Owners and the Owners' heirs, successors and assigns, hereby agree to the recording of this resolution in the chain of title of#he Property.
