Applicanfs have filed Zoning Application#12- form tiy r q estin the City to review plans for <br /> construction of a new residence reauiring variances located at '`��s� �� so the"Subject Property") <br /> as more fully shown and described as 3 � k� <br /> Counfv of Hennenin.. <br /> 2. � Appiicants request the City to review said plans which requires City approval including variances <br /> involvinq c�ty enqineerinq, leqal and planninq review. <br /> 3. The City is willing to commence its review of the appiication and incur costs associated with said <br /> review only if the Applicants establish an escrow to ensure reimbursement to the City of its costs. <br /> NOW THEREFORE,THE PARTIES AGREE AS FOLLOWS: <br /> 1. DEPOSIT OF ESCROW FUNDS. Contemporaneously with the execufion of this E'scrow <br /> Agreement, the Applicants shall deposit 2500.00 with the City. A{i accrued,interest, if any, shall be paid to the <br /> City to reimburse the City fnr its cost in administering the escrow account. <br /> . 2. PURPOSE OF ESCROW. The purpose of the escrow is to guarantee reimbursement to the City <br /> for all out-of-pocket t�sts the City has incurred (incfuding pianning, engineering, or legal consultant review)or will <br /> incur in meeting with the A�licants, reviewing the plans, and preparing agenda packet material for City Council <br /> review of application#12- • 'S�SEligible expenses shafi be consistent with expenses the Applicants would�be <br /> responsible for under a zoning and subdivision appiication. <br /> 3. MONTHLY BILLING. As the City receives consultant bills for incurred costs, the City w(II in tum <br /> send a biil to the Applicants. Applicants sha(I be responsibie for payment to the City within 30 days of the <br /> Applicants'receipt of bfil. <br /> 4. DISBURSEMENT FROM ESCROW ACCOUIVT. In the event that the Applicants do not make <br /> payment to the City within tMe timeframe outlined in#3 above, shall cease all reviews until the Applicants pay all <br /> expenses invoiced pursuant to#3. The City may draw from the escrow account wlthout further approval of the <br /> Applicants to reimburse the City for eligible expenses the City has incurred. <br /> 5. CLOSING ESCROW. The Balance on deposit in the escrow, if any, shall be retumed to the <br /> Applicants when the review has been completed. <br /> 6. CERTIFY UNPAID CNARGES.
