� O� <br /> O � ° <br /> ��, C ITY of ORONO <br /> � ti <br /> '� RESOLUTION OF THE CITY COUNCIL <br /> ��'9.k'E Hp4ti'�'G NO. `3 "7 � $ <br /> S <br /> CONCLUSIONS, ORDER AND CONDITIONS <br /> Based upon one or more of the above findings, the Orono City Council hereby <br /> grants variances to the Municipal Zoning Code Sections noted above that would permit the <br /> completion of the construction of an upper level deck and grants a structural coverage increase <br /> of 14.9 s.f. or 0.1%, and hardcover variance of 1,276.3 s.f. or 18.4% and a 21' encroachment <br /> of the average lakeshore setback line, subject to the following conditions: <br /> 1. Applicant shall obtain a penalty building permit before proceeding with <br /> construction on unfinished deck. Applicant to contact Building Official to <br /> determine what type of information will be needed to complete the filing of the <br /> building permit application. <br /> 2. Existing hazdcover improvements consisting of 50.6 s.f. of lower level deck and <br /> plastic underliner beneath deck to be removed prior to the framing inspection by <br /> the Building Inspector. <br /> 3. Authorities granted by this resolution run with the property not with the <br /> applicant, but are permissive only and must be exercised by application for a <br /> building permit within one year of the date of Council approval, or this variance <br /> will expire on that date (August 12, 1997). <br /> 4. Violation of or non-compliance with any of the terms and conditions of this <br /> variance shall constitute a violation of the zoning code, shall automatically <br /> terminate any authority granted herein, and shall be punishable as a <br /> misdemeanor. <br /> 5. The undersigned applicant has read, understood and hereby agrees to the terms <br /> of this resolution and on behalf of himself, his heirs, successors and assigns, <br /> hereby agrees to the recording of this resolution in the Chain of Title of the <br /> property. <br /> Page 3 of 5 <br />
