VOTE: Ayes 5, Nays 0.

6. #09-3428 MICHAEL AND MARILYN HUTHWAITE, 3382 BAYSIDE ROAD –
VARIANCES – RESOLUTION NO. 5887

Jeremy Steiner, Attorney-at-Law, and Rick Hendel, Builder, were present.

Curtis noted the applicant originally was requesting a conditional use permit for grading within 75 feet of
Stubbs Bay Creek as well as lot area, creek setback, and hardcover within the 0-75 foot and 75-250
setback zone variances in order to construct a replacement residence. At that time the Planning
Commission directed the applicant to address the following:

1. The footprint of the home should be reduced in order to better fit within the required street, side,
and creek setback. The creek setback was identified as a priority.

2. The attached garage could be reduced in order to alleviate a portion of the encroachment into the
creek setback.

In addition, the Planning Commission seemed to feel the CUP for stream bank stabilization and the
variances for the proposed crossing or footbridge over the creek were acceptable.

Item #02 - CC Agenda - 12/14/09
Approval of Council Minutes 11/23/09
