Box 66 <br /> Crystal Bay, MN 55323 <br /> Re: Otto Residence <br /> BRA File No. 139-2041 <br /> Dear Lyle: <br /> We have reviewed the grading for the property owned by Phillip Otto, 41 16 Highwood Road, <br /> and have found that the finished grading does not conform to the previously approved plans. <br /> The previously approved grading plan was submitted in 5eptember of 1995. This plan proposed <br /> only minor filling below the 956 contour (see Exhibit 1). Our initial review concluded that the <br /> grading plan was acceptable and would have minimal effects on the storage capacity of the pond <br /> (see attached letter). <br /> The completed grading plan submitted in October of 1996 shows up to a six-foot depth of <br /> additional fill below the 956 contour. Also, it appears that the applicant has filled portions of the <br /> adjoining properties. The increase in fill is distinctly stiown near the existing maple tree, which <br /> has up to five feet of fill placed around it (see Exhibit 2). <br /> The north half of this lot is part of a storm water ponding area that provides storage for 3.4 acres <br /> of direct drainage and 16.5 acres of indirect drainage. This ponding area has a history of <br /> flooding problems due to an inadequate pipe outlet between the pond and Lake Minnetonka. <br /> Because it is unknown if this outlet pipe will ever be replaced, it is very important to maintain <br /> the storage volume of this ponding area. The amount of fill significantly lowers the storage ' <br /> capacity of the pond and would increase the potential of flooding the adjacent homes. <br /> To alleviate the potential flooding problem, the fill in the low area below the existing 954 <br /> contour must be removed. In addition to the increased fill, it appears that the grading has <br /> extended beyond the property lines.
