The Public Works Director has reviewed the second curb cut at the southwest <br /> comer of the property and approved the location and use of a second curb cut <br /> finding an improvement in safety based on the narro«ness of Highwood <br /> Road and the number of dv��elling units served by this substandard roadway. <br /> c. Land alterations will not involve or encroach the adjacent property to the <br /> east. <br /> d. The two-tiered interlocking block retaining wall located 4' from the west side <br /> lot line has been installed per the specifications of the manufacturer providin� <br /> for the treatment of drainage to the rear of the walls. <br /> e. Proposed fill placed within the north yard of the property will not impact the <br /> stormwater facility installed to the east. <br /> 4. The City Council finds that granting a conditional use pemut to allow the excavation <br /> and fillina of 200 cubic yards of soil withi.n this property will not be detrimental to <br /> the health, safety or general welfare of the public, would not adversely affect light, <br /> air nor pose a fire hazard or other danger to neighboring properties, nor��ill its use <br /> depreciate surrounding property values and that the proposed level of use of the <br /> property will be in keeping with the intent and objectives of the Zoning Code and <br /> Comprehensive Plan of the Cit}�. <br /> 5. The City Council has considered this application including the findings and <br /> recommendations of the Planning Commission, reports by City staff, comments by <br /> the applicant and the effect of the proposed variance on the health, safety and welfare <br /> of the community. <br /> CONCLUSIONS, ORDER AND CONDITIONS <br /> Based upon one or more of the above findinas, the Orono City Council hereby Qrants <br /> a conditional use pernut per Municipal Zoning Code Section 10.03, Subdivision 19 to permit land <br /> alterations as shown on the enclosed grading and drainage plan included a� Page 6 of this <br /> resolution, subject to the following conditions: <br /> PaQe 2 of 6 <br />
