VOTE:
Ayes 4, Nays 0.

Interim City Administrator Kiedrowski noted he has begun the process of compiling a list of items that
should be addressed this summer and that he welcomes the opportunity to work for the City of Orono.

CITY ATTORNEY’S REPORT

Mattick reported on the issue relating to state aid, noting that Kevin Hoglund of Bonestroo attended
the subcommittee meeting of the screening board. The subcommittee indicated they do not like the
classification of private streets given by the City to certain streets and that they do not like the fact that
the City does not maintain those streets. Mattick stated it would be the subcommittee’s
recommendation that the City should receive the current levels of funding at this time, will not be
assessed a fine, but that the City should assume maintenance responsibility of those streets.

Murphy asked who would be defining the word maintenance.

Mattick stated it is his understanding the City would need to assume a level of maintenance
responsibility similar to what is being done on non-private streets.

Murphy asked why this issue is being limited to just the City of Orono and not state-wide.

Mattick noted that item was discussed and that the engineer for the City of Minnetonka indicated that
they do not count the private roads within their state aid calculation.

Item #02 - CC Agenda - 05/12/08
Approval of Council Minutes 04/28/08 [Page 7 of 9]
