The Planning Commission has <br />recommended that a temporary variance be granted to allow the fence to remain for an interim period of <br />time while the owner re-establishes vegetative screening. The variance will expire on December 31, <br />2008, and the fence is to be removed by that date. If the fence is not removed, the City may remove the <br />fence and assess the cost to the property. <br /> <br />Murphy moved, Bremer seconded, to direct Staff to draft an approval resolution incorporating <br />the recommendations of the Planning Commission. VOTE: Ayes 5, Nays 0. <br /> <br /> <br />7. #07-3325 GARY DeSANTIS, 80 WEAR LANE – PRELIMINARY PLAT – <br />RESOLUTION NO. 5702 <br /> <br />Gary DeSantis, Applicant, and Mark Gronberg, Surveyor, were present. <br /> <br />Curtis stated the applicant has submitted an application for a subdivision for a two-lot residential plat of <br />property within the RR-1B District, which requires 2-acres of dry buildable area and 200 feet of width <br />per lot. The proposal consists of the division of one existing 5-acre parcel resulting in two 2 plus acre <br />parcels. A lot width variance would be required for each of the newly created lot. The existing lot at 80 <br />Wear Lane meets the 200 foot minimum width requirement at the building setback. Neither of the <br />proposed new lots will meet the minimum width at the building setback. <br /> <br />At its November meeting, the Planning Commission voted 5-1 to recommend approval of the lot width <br />variances and preliminary plat as requested. <br /> <br />Planning Staff recommends approval of the lot width variances and the preliminary plat with the <br />following conditions: <br /> <br />1. The plat shall be subject to the City Engineer’s recommendations (both John Smyth and Darren <br />Amundsen). <br /> <br />2. That the applicant upgrade Wear Lane and the cul-de-sac as well as pave the cul-de-sac to meet <br />City standards. <br /> <br />3. The plat shall adhere to all MCWD requirements. <br /> <br />Staff recommends adoption of the resolution attached to the Council Action memo. <br /> <br />White noted this is an odd shaped lot and that it is difficult to create two totally conforming lots. <br /> <br /> <br /> <br />PAGE 3 <br />Item #02 - CC Agenda - 01/14/08 <br />Approval of Council Minutes - 12/10/07 [Page 3 of 17]
