Mattick stated based on the lot size, that lot would still be buildable. <br /> <br />Curtis noted the side lot setback is 10 feet. <br /> <br />Printup stated he is uncomfortable with approving the plan tonight without hearing back from the <br />Watershed District and any possible changes to the grading plan that may be required. <br /> <br />Rahn asked if the applicant is in a hurry to develop this property. <br /> <br />Sather indicated they have not received a good clarification from the Watershed District, but noted they <br />are in the process of closing on the property and that they would like to get approval prior to purchase. <br /> <br />Rahn stated whether it would affect their planning process if this was approved at the next council <br />meeting. <br /> <br />Sather indicated it would. <br /> <br />Franchot noted this is a preliminary plat approval and that the Council would be able to review it again at <br />the time they request final plat approval. <br /> <br />Mattick stated that is correct but that typically the Council requires the application to be largely in <br />compliance with preliminary plat approval. <br /> <br />Bremer stated she would be fine approving the application subject to the applicant receiving approval <br />from the Watershed District. <br /> <br />Curtis stated Staff can bring the preliminary plat resolution back before the City Council and then <br />schedule the final plat for another meeting; or if clear direction is given at tonight’s meeting for the final <br />plat request, and if all the requirements are met, then the Council could vote on both the preliminary and <br />final plat at the next Council meeting. <br /> <br />Rahn asked if there are no changes whether it would be brought back for final plat approval. <br /> <br />Curtis stated there would be a preliminary plat resolution and a final plat resolution. <br /> <br />Mattick stated it is not uncommon to combine preliminary and final plat approval. <br /> <br />Bremer moved, Franchot seconded, Application #11-3526, 3515 Capital Partners, LLC, 1545 Maple <br />Place, to direct Staff to draft approval resolutions for both preliminary and final plat subject to the <br />applicant receiving approval by the Minnehaha Creek Watershed District and provided that the <br /> <br />Item #03 - CC Agenda - 10/24/2011 <br />Approval of Council Minutes 10/10/2011 [Page 9 of 13]
