The applicant proposes to conduct the <br />grading work to create the storage swale on their property at their expense to accommodate the regional <br />storm water levels. The additional off-site work can possibly be performed by the City’s Public Works <br />staff at a reasonable cost to the City. The money to fund this project can be pulled from the Storm Water <br />Fund, which is collected from the storm water drainage trunk fees and the quarterly storm water utility <br />fee. <br /> <br />The applicant will grant an easement over the storage swale which could possibly be an extension of the <br />required drainage and utility easements with the plat. It is Staff’s recommendation that the City maintain <br />the storage swale which would entail mowing two to three times per year, inspections for sediment levels <br />and sediment removal as necessary, possibly every five years. Requiring installation of signage to <br />demark the easement boundary is also a consideration. <br /> <br />The applicants have not yet submitted a permit application to the MCWD. Staff has requested the <br />applicant contact the MCWD to determine what requirements, if any, they will place on this plat, because <br />it is unclear whether their requirements will change the grading plan. Based on Staff's understanding of <br />their rules, there is a potential the MCWD may require storm water management practices or facilities <br />which could cause changes to this currently proposed grading and site plan. For this reason Staff is not <br />comfortable in granting preliminary plat approval until it can be confirmed that any MCWD requirements <br />will not change this plan. <br /> <br />Basement types may be limited due to the proximity of the water table. The applicant is proposing to <br />establish building pad elevations with the plat. This would allow homes to be constructed on the sites <br />using the newly established grade as "existing" grade for purposes of building height calculation. Their <br />plan reflects look-out basements resulting in first floor elevations approximately five to nine feet above <br />the road. Additionally, these elevations appear to create driveways which approach 10 percent grades. <br /> <br />The applicant is amendable to working with the City toward a solution to the storm water issues. In <br />addition to MCWD approval, the current plans may require slight modification to achieve the desired <br />results. <br /> <br />Staff recommends approval of the preliminary plat based on the recommendations in the state statute <br />regarding lot area and width, contingent on reaching a mutually beneficial resolution to the storm water <br />issues. <br /> <br />Rahn asked if there are no new requirements by the MCWD whether Staff is okay with the application. <br /> <br />Curtis indicated Staff does have some minimal changes to the grading plan and that the applicant has <br />indicated he is amenable to working with Staff. <br /> <br />McMillan asked how much fill would need to be brought in for the building pads. <br /> <br />Curtis indicated she is not sure at this time how much fill would be required. <br /> <br />McMillan asked how deep the storm water ponds would be. <br /> <br />Curtis indicated they would be grassy swales and the majority of the time they would be dry. <br />Item #03 - CC Agenda - 10/24/2011 <br />Approval of Council Minutes 10/10/2011 [Page 7 of 13]
