MINUTES OF THE <br />ORONO CITY COUNCIL MEETING <br />Monday, September 12, 2011 <br />7:00 o’clock p.m. <br />_____________________________________________________________________________________ <br /> <br /> Page 22 of 28 <br /> <br />(10. #11-3521 TAMI HELMER, 3131 CASCO CIRCLE, Continued) <br /> <br />Helmer indicated since the Planning Commission meeting they have called them and they have indicated <br />they are in support of the project. They were asked to provide a written statement of support, which was <br />not done, but that they did receive a verbal statement of support. <br /> <br />Rahn stated in his view it is a matter of moving a nonconformity. Rahn stated they have the rule so that it <br />does not cause an impact to the neighbors even if it is minimal. <br /> <br />Sharratt stated instead of making this less nonconforming, they are faced with the decision to leave the <br />deck that is currently there and putting a screen porch underneath that portion. <br /> <br />Suzann Passet stated the issue comes back to practical difficulty and that they have not addressed whether <br />there is a practical difficulty. <br /> <br />Rahn asked whether screening on the underside of the deck would be allowed. <br /> <br />Curtis indicated that would be allowed since it is already considered structure. <br /> <br />Rahn asked if that would be allowed even though it is in front of the average lakeshore setback. <br /> <br />Curtis indicated they can add the screen porch underneath the deck but not above. <br /> <br />Rahn asked if the applicants would like to table the application. <br /> <br />Helmer stated she would like some clarification and asked whether the entire application would be denied <br />or whether the different aspects of the application could be considered separately. <br /> <br />McMillan commented it may be best to table the application since it does not appear it will be approved. <br /> <br />Sharratt asked whether the Council is against all the issues or simply the screen porch. Sharratt stated he <br />would like direction from the Council. <br /> <br />Rahn stated it is an average lakeshore setback issue and that any alterations in front of the average <br />lakeshore setback would be an issue. <br /> <br />Franchot asked how that would impact the dormers. <br /> <br />Sharratt stated to his belief they would be okay. Sharratt requested that they be given some time to <br />discuss their options. <br /> <br />(This application was adjourned from 10:10 to 10:38 p.m.) <br /> <br />Sharratt requested the existing first floor plan be displayed on the overhead.
