WETLAND DELINEATIONS CODE INTERPRETATION, Continued) <br /> <br />McMillan commented she is not familiar with the banking system and that it is likely something to do <br />with the developer. <br /> <br />Gaffron noted Orono’s Code does not address the issue of wetland banking. Wetland banking has been <br />used in various projects in the City so it is not prohibited and the City might entertain it depending on the <br />project. <br /> <br />Struve stated there is a process to bank wetlands but a person would need to go through BWSR. Struve <br />indicated he is not knowledgeable of the exact requirements and that he would have to look at what was <br />required as part of the Willow View development. Struve noted it would not be a City process but would <br />be through BWSR. <br /> <br />McMillan asked if that applies to after the development. <br /> <br />Struve stated he cannot speak on BWSR’s behalf and that if Mr. Kanive would like to explore that option, <br />he can provide that information to him. <br /> <br />Kanive stated these lots were sold without any wetland delineations on the title and that he is attempting <br />to work within those confines versus properties that have them clearly marked. <br /> <br />McMillan stated she had her property delineated in 1996, and that if she did something new on her <br />property, a new delineation would be required. <br /> <br />Kanive stated in his view five years is not fair to the homeowners. <br /> <br />McMillan noted that is dictated by the state board based on certain criteria. <br /> <br />Kanive asked if Orono has any authority to change that. <br /> <br />Mattick stated it probably would be the homeowner’s best interests to know the wetland boundaries. <br /> <br />Kanive noted his neighborhood has also experienced negative impacts from other developments and that <br />the wetlands were expanded to twice the size to accommodate those developments. <br /> <br />Levang moved, Anderson seconded, to direct Staff to forward the information pertaining to the use <br />of older wetland delineations to Amy Hubbard, 945 Willow View Drive.
