MINUTES OF THE <br />ORONO CITY COUNCIL MEETING <br />Tuesday, June 10, 2013 <br />7:00 o’clock p.m. <br />_____________________________________________________________________________________ <br /> Page 11 of 32 <br />(8. #13-3605 BRIAN AND REBECCA HENNING, 245 TONKA AVENUE, VARIANCES – <br />PUBLIC HEARING, Continued) <br /> <br />McMillan asked if a building permit would be required for that size of a shed. <br /> <br />Curtis indicated it would either be a zoning permit or a building permit. <br /> <br />McMillan asked if it would also require a building permit even if it is in the back yard. <br /> <br />Curtis indicated it would still require either a building permit or a zoning permit. If the shed is less than <br />120 square feet, it would require a zoning permit. <br /> <br />Bremer stated if it had been in a conforming location, it would have been allowed. <br /> <br />Printup asked how much a zoning permit is. <br /> <br />Curtis stated to her knowledge it is $50. <br /> <br />Printup asked how much the after-the-fact fee would be. <br /> <br />Curtis indicated it would be double that $100. <br /> <br />Bremer commented this is a tough situation given the limited view of the shed. Bremer indicated she is <br />familiar with the area and that she did have a question about the shed when she saw the property. Bremer <br />indicated she would be willing to allow the shed in its location since the neighbors are not opposed to it <br />and also given the landscaping in the back if the rest of the City Council feels the same way. Bremer <br />noted the Council has on a couple of occasions allowed a shed in the front yard but that was due to the <br />topography of the yard. <br /> <br />Levang moved, Printup seconded, to approve Application #13-3605, Brian and Rebecca Henning, <br />245 Tonka Avenue, and to direct Staff to draft a resolution allowing the deck. VOTE: Ayes 4, <br />Nays 0. <br /> <br />Levang moved, Printup seconded, to deny the setback variance for the shed located at 245 Tonka <br />Avenue.
