A typical <br />failure would be in the interface between the rock and the sand, and that in his view it is not an issue. <br /> <br />McMillan asked whether there should be a condition that once the new residence is constructed, that the <br />old residence be removed. <br /> <br />Gozola stated typically there is a code provision that only allows for one dwelling per parcel. <br /> <br />McMillan commented it would not hurt to include that as a condition. McMillan asked when the wetland <br />buffer would be triggered. <br /> <br />Gozola indicated the buffer requirement is being triggered given the amount of dirt being moved. <br /> <br />McMillan asked if the applicant simply grades the new building pad and does not construct a new <br />residence for a couple of years, whether that would be acceptable. <br /> <br />Gozola stated the CUP is not attached to their future actions. Given the way the applicant is proposing to <br />move the dirt, the existing house will need to be removed. If the house remains, they would have to meet <br />all the CUP conditions, which includes establishment of the buffer. <br /> <br />Gozola displayed the reconfiguration of the driveway on the overhead. Gozola noted the applicant would <br />like to add a turnaround in front of the house. Gozola noted hardcover is not regulated on this property <br />and the turnaround would not change the proposed grading. <br /> <br />Rahn asked whether conditions number nine and number ten would be eliminated. <br /> <br />Bremer stated number nine would be eliminated and then the condition requiring the existing home be <br />removed will be added. <br /> <br />McMillan commented she would also be okay with elimination of condition number ten. <br /> <br />Rahn moved, Bremer seconded, Application #12-3539, Surya and Anthony Rochel, 125 Turnham <br />Road, to direct Staff to prepare an approval resolution, with the elimination of Item Nos. 9 and 10, <br />and with the addition of the condition that the existing home be removed prior to the certificate of <br />occupancy being issued. VOTE: Ayes 5, Nays 0. <br /> <br /> <br />8:00 P.M. - HRA ANNUAL MEETING <br /> <br />Bremer moved, Franchot seconded, to recess the City Council meeting and to open the HRA <br />meeting. VOTE: Ayes 5, Nays 0. <br /> <br />(The Orono City Council meeting was recessed from 8:01 p.m. to 8:03 p.m.) <br /> <br />Bremer moved, Franchot seconded, to reopen the City Council meeting.
