A standard lakeshore lot with 55,500 s.f. in area would have yielded much <br /> higher hardcover allowances within the 75-250' setback zone. <br /> C. The property is located on a peninsula. <br /> D. The property contains unique topographical constraints. <br /> E. The house has been specifically designed to limit the need for horizontal <br /> expansion beyond building footprint to provide additional outdoor <br /> recreational space. <br /> F. Surface runoff from 25.2% of the tota132.5% of hardcover improvements <br /> will be treated within a drainf'ield area and will not run directly into lake. <br /> G. A small wing of the new residence will be at a three-story height. <br /> 4. The City Council finds that the conditions existing on this property are peculiar <br /> to it and do not apply generally to other property in this zoning district; that <br /> granting the variance would not adversely affect traffic conditions, light, air nor <br /> pose a fire hazard or other danger to neighboring property; would not merely <br /> serve as a convenience to the applicant, but is necessary to alleviate a <br /> demonstrable hardship or difficulty; is necessary to preserve a substantial property <br /> right of the applicant; and would be in keeping with the spirit and intent of the <br /> Zoning Code and Comprehensive Plan of the City. <br /> 5. The City Council has considered this application including the findings and <br /> recommendations of the Planning Commission, reports by City staff, comments <br /> by the applicant and the effect of the proposed variance on the health, safety and <br /> welfare of the community. <br /> CONCLUSIONS, ORDER AND CONDITIONS <br /> Based upon one or more of the above findings, the Orono City Council hereby <br /> grants variances to Municipal Zoning Code Sections 10.22, Subdivision 2 granting a hardcover <br /> variance within the 75-250' setback area of 1,037 s.f. or 7.5% and per Section 10.24, <br /> Subdivision 5 (A) grants a height variance for a small portion of the residence that will be at a <br /> three-story height instead of at 21h stories, subject to the following conditions: <br /> Page 2 of 5 <br /> Fam 5005 Dlsk Omrv <br />
