MINUTES OF THE <br />ORONO PLANNING COMMISSION MEETING <br />Monday, November 18, 2013 <br />6:30 o’clock p.m. <br />_____________________________________________________________________________________ <br /> <br />Page 17 of 35 <br /> <br />Thiesse stated if there is a trail easement across the whole utility easement and people use it to get to the <br />park, whether they would be able to walk through the wetland. <br /> <br />Gaffron stated they would be able to walk through the wetland if it is dry but that there are restrictions <br />against building anything in the wetland. <br /> <br />Thiesse stated the 20-foot easement plus the conservation easement would meet the City’s requirement <br />for the 10 percent recreation area. <br /> <br />Abbott asked if the utility easement is the one they have to rewrite <br /> <br />Gaffron indicated it is not and that the one that needs to be rewritten is for the creek since it does not <br />follow the actual creek bed. <br /> <br />Landgraver stated he is not sure what the conclusion is on the trail easement. <br /> <br />Thiesse stated the trail easement would be over the utility easement and would help the developer meet <br />the 10 percent recreation area. <br /> <br />Landgraver indicated he is in agreement with that. <br /> <br />Gaffron stated the next issue to discuss is whether there should be a homeowners association. <br /> <br />Thiesse stated he does not favor an outlot. <br /> <br />Gaffron stated there does not seem to be the need for one. <br /> <br />It was the consensus of the Planning Commission to not recommend the creation of a homeowners <br />association. <br /> <br />Gaffron asked whether the Planning Commission would like to send this application on to the City <br />Council. <br /> <br />Leskinen indicated she would be comfortable doing that. <br /> <br />Thiesse stated in his view the development fits the area. <br /> <br />Leskinen stated she is in agreement and that it is a nice development that fits in well with the area. <br /> <br />McGrann moved, Thiesse seconded, to recommend approval of Application No. 13-3637, William <br />Abbot, 2350 Watertown Road, preliminary plat approval and rezoning to Residential Planned Unit <br />Development, subject to the granting of a conservation easement, vacation of the existing easement <br />through Lots 3, 4, and 5 and a new easement being rededicated in a more correct location, and <br />subject to the dedication of a utility easement over Lots 1 and 2, with the utility easement being <br />counted towards the recreation area, and subject to a more robust landscape plan.
