MINUTES OF THE <br />ORONO PLANNING COMMISSION MEETING <br />Tuesday, January 20, 2015 <br />6:30 o’clock p.m. <br />_____________________________________________________________________________________ <br /> <br />Page 20 of 21 <br /> <br />9. #15-3710 AMEND SECTION 78-1286(B & D) REGARDING CHANGES TO THE <br /> REQUIREMENTS FOR TOPOGRAPHIC ALTERATIONS/GRADING AND FILING <br /> ACTIVITIES, 8:29 P.M. – 8:33 P.M. <br /> <br />Gaffron stated the amendment before the Planning Commission modifies the conditional use permit <br />provisions for site grading by increasing the administrative permit threshold from 10 to 50 cubic yards for <br />shoreland properties within the 0-75 foot setback area. It establishes new standards and streamlines <br />administrative zoning permit approvals for grading in the 0-75 foot lakeshore setback for things like in- <br />ground stairways, ice ridge corrections, landscaping, etc. Staff is in favor of raising it to 50 cubic yards <br />since it would avoid the need for people to go through a long-drawn out process for something that may <br />be very minimal. <br /> <br />Gaffron noted the Planning Commission supported changes to increase the 10 cubic yards to 50 cubic <br />yards but did not support changing the 500 cubic yard threshold to 1,500. The reason was that there are a <br />very small number of these cases that come up per year and the amount of trucks associated with 500 or <br />more cubic yards and the potential for substantial disruption without a building project warrant an <br />opportunity for neighborhood notices. <br /> <br />Staff recommends approval of the zoning text amendment. <br /> <br />Chair Leskinen opened the public hearing at 8:32 p.m. <br /> <br />There were no public comments regarding this application. <br /> <br />Chair Leskinen closed the public hearing at 8:32 p.m. <br /> <br />Leskinen noted the Planning Commission discussed this at their January work session and that she is <br />comfortable with the change. <br /> <br />Schoenzeit moved, Landgraver seconded, to recommend approval of Application No. 15-3710, <br />Amend Section 78-1286(b & d) regarding changes to the requirements for topographic <br />alterations/grading and filing activities. VOTE: Ayes 6, Nays 0. <br /> <br />PLANNING COMMISSION COMMENTS <br /> <br />10. REPORT FROM PLANNING COMMISSION REPRESENTATIVES ON CITY <br /> COUNCIL MEETINGS HELD ON NOVEMBER 24, 2014, DECEMBER 8, 2014, AND <br /> JANUARY 12, 2015 <br /> <br />Thiesse stated he attended the November 24 Council meeting. The Source Land Capital comprehensive <br />plan amendment was approved and the Marquardt application was tabled at the request of the applicant to <br />allow them time to reduce the size of the deck. <br /> <br />Landgraver stated at the December 8 Council meeting the Land Source preliminary plat was approved. <br /> <br />Curtis noted the portion of the Marquardt application for the deck was denied. <br /> <br />Item #01 - PC Agenda - 02/17/2015 <br />Approval of Planning Commission Minutes [Page 20 of 21]
