� <br /> 1 <br /> Council review. <br /> 2. Hardcover shall not increase above 30% as allowed in Tier 2. Any changes to the <br /> plans or the Property which result in an increase in hardcover above the allowed level <br /> will require further Planning Commission and City Council review and a new variance <br /> request. <br /> 3. Structural coverage shall not increase above 15% as allowed by Code. <br /> 4. The extent of the approved improvements within the City's rights-of-way is depicted <br /> on the approved plan attached as Exhibit A. The Owner shall not install or construct <br /> structures or other obstructions within the City's rights-of-way, and shall not plant <br /> landscape improvements within the City's rights-of-way nor so close to the rights-of- <br /> way as to create a future encroachment without City approval. <br /> 5. Authorities granted by this resolution run with the Property not with the Owner, but <br /> are permissive only and must be exercised by obtaining a building permit for the new <br /> construction and commencing construction of said project. A framing inspection must <br /> be completed within one year of the date of Council approval, or the variances will <br /> expire on that date (March 9, 2016). <br /> 6. Violation of or non-compliance with any of the terms and conditions of this resolution <br /> shall constitute a violation of the zoning code, shall automatically terminate any <br /> authority grarrted herein, and shall be punishable as a misdemeanor. <br /> 7. The undersigned Owner has read, understands and hereby agrees to the terms of <br /> tfiis resolu#ion and on behalf of their heirs, successors and assigns, hereby agrees to <br /> the recording of this resolution in the chain of title of the Property. <br /> Adopted by the Orono City Council on this 9th day of March, 2015. <br /> Page 4 of 5 <br />
