4. The City Council finds that the conditions existing on this Property are peculiar to <br /> it and do not apply generally to other property in this zoning district; that granting <br /> approval of revisions to the site plan previously approved for variances would not <br /> adversely affect traffic conditions, light, air nor pose a fire hazard or other danger <br /> to neighboring property; would not merely serve as a convenience to the <br /> Applicants, but is necessary to alleviate a practical difficulty; is necessary to <br /> preserve a substantial property right of the Apglicants; and would be in keeping <br /> with the spirit and intent of the Zoning Code�nd Comprehensive Plan of the City. <br /> CONCLUSIONS, ORDE�tt AND CONDITIONS <br /> Based upon one or more of th� above findings, the Orc�o City Council hereby <br /> grants a revision to the site plan approved via Re�lution No. 6407 in order to allow replacement <br /> of the pre-existing block retaining wa11s along Cryst�l Bay Road with boulder walls, all of which <br /> will be less than 4 feet in height; and to allow re-orie�t�tion of the approved parking stall to be <br /> parallel to Crystal Bay Road rather �than �erpendicular to it, such sta11 to be approximately 24 <br /> feet in width and 7-10' deep, in the location oftl� existing driveway and slightly west of it; and <br /> to allow reconfiguration of the front walkvvay and st�s; all subae�ct to the following conditions: <br /> 1. Council approval is based on the revisecl site plan survey submitted by the Applicants and <br /> annotated by City staff, attached to this Resolution as Ezhibit A, Any amendments to <br /> the revised site plan whic� are not in co�formity with City codes will require further <br /> Planning Crnnmission a�d Cifiy Cauncil review. <br /> 2. Applicants shail obtain a separate builtiing permit for construction of the boulder walls <br /> prinx to commencem�nt of canstruction. <br /> 3. Under the revised site plan, Co�dition 4 of Resolution No. 6407 requiring a fence or <br /> other pasitive safety bazriers sha11 be placed above the retaining walls that surround the <br /> lower parking area, is no lomger required. <br /> 4. All other cond�tions of R�solution No. 6407 shall remain in full force and effect. <br /> 5. Authorities granterl by this resolution run with the property not with the Applicants, but <br /> are permissive only and must be exercised by obtaining a land alteration permit for the <br /> boulder wall system within one year of the date of Council approval, or the approvals <br /> granted herein will expire on that date (February 9, 2016). <br /> Page 3 of 5 <br />
