� <br /> File#14-3664 <br /> February 3,2015 <br /> Page 2 <br /> of the pre-existing detached garage, and included revisions to the walls abutting the garage <br /> space. <br /> The applicants are now proposing to replace the pre-existing walls (since removed) along Crystal <br /> Bay Road and replace with boulder wa11s, all of which will be less than 4 feet in height. Further, <br /> rather than creating a parking stall perpendicular to the road, they propose to create a parallel <br /> stall, approximately 24 feet in width and 7-10' deep, in the location of the existing driveway and <br /> slightly west of it. The front walkway and steps will also be slightly reconfigured. These <br /> revisions require an amendment of the approved site plan. <br /> Please review the 10/14/14 PC memo and 10/20/14 PC minutes for additional detail. Public <br /> Works Director Adam Edwards reviewed the proposed layout and found it acceptable. <br /> Staff Recommendation <br /> Crystal Bay Road is narrow with minimal if any areas wide enough for on-street vehicle parking <br /> without causing difficulty for other vehicles. The proposed parking stall appears to be located so <br /> as not to intrude into the traveled right-of-way, and will be located no closer to the traveled road <br /> than the existing concrete walls. Crystal Bay Road exists via a prescriptive easement, not <br /> dedicated on any plat or through any formal easement process. The public by virtue of many <br /> decades of use and maintenance has the right to continue use of the traveled roadway. The <br /> parking stall will be on private property (but within 10' of the paved roadway), and it will be up <br /> to the property owner to manage any unintended public use of the stall. <br /> Staff recommends approval of the reconfigured walls/driveway/sidewalk, and installation of <br /> boulder walls per the proposed plan, subject to a11 other conditions of the 2014 variance & CUP <br /> approval including the limitation to 36.6%hardcover, and that the area streetward of the walls be <br /> paved. <br /> COUNCIL ACTION REQUESTED <br /> Adopt or amend the attached Resolution Amending the Conditions of Resolution No. 6407 - <br /> File#14-3664. <br />
