t <br /> 4) Implementation of Official Controls such as construction site erosion control, <br /> wetland buffers, and ordinance updates. <br /> Annual planned City expenditures in these four areas total approximately $250,000 to <br /> $350,000. <br /> Funding Sources. NPDES obligations and operation & maintenance of the storm <br /> water system are primarily funded through Orono's Storm Water Utility (authorized per <br /> Ord. 213, 2"d S. adopted 12/10/2001) which is a $15.84 quarterly fee (2014) charged <br /> to each existing dwelling unit on a unit basis and to each developed commercial <br /> property based on a Residential Equivalent Factor. <br /> Implementation of official controls is primarily funded through user fees such as <br /> building permit and land alteration permit fees. <br /> The level of funding needed for planned capital improvement projects, however, is not <br /> fully covered by the Storm Water Utility or permit fees. Additionally, future anticipated <br /> requirements for phosphorus reduction in specified local water bodies as a result of <br /> federally mandated Total Maximum Daily Load (TMDL) studies will likely result in even <br /> greater funding needs for as-yet undefined stormwater projects. The funding sources <br /> for these capital projects can be broken down into 4 components: <br /> a) Storm Water & Drainage Trunk (SW&DT) Fee charged to New Development <br /> b) Storm Water & Drainage Trunk Fee charged to Redevelopment or Expansion* <br /> c) Storm Water Utility Fees <br /> d) Grants, Cost-Sharing and other alternatives for funding a variety of projects <br /> *The redevelopment/expansion element of the SW&DT Fee structure has not been <br /> implemented based on past Council direction, and a recent review by staff and the City <br /> Attomey suggests that significant revisions in the provisions for this element are needed prior <br /> to its implementation - see below under SW8�DT Fee Administration Issues. <br /> SW&DT Fee Background. Ordinance 214, 2"d S. adopted 12/10/2001 established <br /> the Storm Water & Drainage Trunk Fee, which authorized the collection of a one-time <br /> fee to be collected at the time of new development. This fee has been charged since <br /> 2002 to all new development involving the creation of new lots for residential <br /> development as well as for new commercial development. <br /> The base per-acre charge for the SW&DT Fee was established in 2002 by estimating <br /> the cost of Water Quality and Water Quantity projects needed to serve 12 <br /> representative properties expected to be developed over the next 5 years, then <br /> dividing by the gross acreage (including wetland) to result in an average cost per acre <br /> for development in the 2-acre zones. An equivalency factor was used to establish per- <br /> acre rates for the 1/2-acre, 1-acre, and 5-acre zones as well as for denser residential <br /> development and commercial development. For the 2-acre zone, the per-acre <br /> SW&DT Fee was set at $2670 per acre in 2002, chargeable to all acreage within a <br /> development including wetlands. That figure has grown to $3780 per acre via inflation <br /> in the ensuing 12 years. See table below excerpted from the 2014 Fee Schedule. <br /> Page 2 of 9 <br />
