�:�0 ���, \ <br /> i; 7' '� �� <br /> ��� � ����� �- - <br /> �''� -- �� `� CITY of ORONO <br /> � ,� � j;��-- � �, �� <br /> � �� �� <br /> � ��. �.����� � �ii; <br /> ��'ii';�!'��,�`;��4'��,�G � RESOLUTION OF THE CITY COUNCIL <br /> �kESH�4� NO. 2 9 8 2 <br /> CONCLIISIONS, ORDER AND CONDITIONS <br /> Based upon the above findings, the Orono City Council hereby <br /> grants a variance to b?unicipal Zoning Code Section 10.03, Subdivision <br /> 14 (C) and Section 10.28, Subdivision 5 (B) to permit the construction <br /> of a 16' x 20' deck with 4' x 10' stairway, Iocated 22' from the left <br /> side lot line where a 30' setback is normally required, 11.3' from the <br /> north side street lot line where a 50' setback is normally required, <br /> and 28' from the rear lot line where a 50' setback is normally <br /> required, and grants a variance to allow 22� lot coverage where only <br /> 15� lot coverage is normally allowed, subject to the following <br /> conditions : <br /> 1. Applicant is advised that future proposals to increase lot <br /> coverage by structures on this property will not be looked <br /> upon favorably by the Council. <br /> 2 . Applicants shall construct the deck per the approved plans. <br /> Any changes from those plans which increase the size or <br /> extent of the deck shall be subject to further City review. <br /> 3. Authorities granted by this variance run with the property <br /> not with the applicant, but are permissive only and must be <br /> exercised by application for a building permit within one <br /> year of the date of Council approval, or this variance will <br /> expire on that date (July 8, 1992). <br /> 4 . Violation of or non-compliance with any of the terms and <br /> conditions of this variance shall constitute a violation of <br /> the zoning code, shall automatically terminate any authority <br /> granted herein, and shall be punishable as a misdemeanor. <br /> 5. The undersigned applicant has read, understood and hereby <br /> agrees to the terms of this resolution and on behalf of <br /> himself, his heirs, successors and assigns, hereby agrees to <br /> the recording of this resolution in the chain of title of <br /> the property. <br /> Page 3 of 5 <br />
