Streeter and Associates <br /> July 13, 1994 <br /> Page 2 <br /> We acknowledge that there is disagreement regarding the number of trees Mr. Oman told you <br /> could be removed. It is clear however, that the scope of tree removal, understory removal, and <br /> total grading of the bluff greatly exceeds what he visualized he was approving, and in no way <br /> conforms to the intent of the variance approval conditions to which the Vergeyles agreed. As <br /> a result, City staff is requiring "inch for inch" replacement of those removed trees identified on <br /> the site plan as being within the bluff and not within the roof overhang line of the house. (See <br /> attached site plan). Since the intent of restoration is to provide both screenin� and slope <br /> stabilit , up to 1/3 of the required 150 diameter inches should be in shrubs or understory <br /> materials. Our intent is that this bluff area be restored to as near the original natural conditions <br /> as possible. <br /> I noted we have been contacted by the DNR regarding this project. Our codes and enforcement <br /> procedures reflect DNR standards for shoreland management. Please refer to the attached <br /> excerpts (6120.3300 Subp. 3D and Subp. A and B) from "Statewide Standards for Management <br /> of Shoreland Areas". <br /> You noted that there may be fill on the site in excess of the amounts needed to complete the <br /> approved grading plan. That fill may be taken off the site, or as you suggested, you may wish <br /> to amend your grading plan and construct a low berm in the street yard. Before doing so, please <br /> provide an amended grading plan for approval. <br /> If you have any questions on any of the above, please feel free to contact me at 473-7357.
