' �7 <br /> ORDINANCE NO. 18�, SECOND SERIES <br /> AN ORDINANCE EXTENDING AN INTERIM MORATORIUM ON <br /> THE GRANTING OF BUILDING PERNIITS,LAND SUBDIVISIONS, <br /> REZOl�TING APPLICATIONS, CONDITIONAL OR SpECIAL USE <br /> PERMITS,VARIANCES,OR OTHER AUTHORITY RELATING TO <br /> ADULT USES IN ALL CONIlVIERCIAL AND INDUSTRIAL <br /> DISTRICTS IN THE CITY OF ORONO <br /> THE CITY OF ORONO DOES ORDAIN: <br /> SECTION 1. Authority. Pursuant to Minnesota Statutes Section 462.355, Subd. 4, <br /> the City is authorized to establish interim ordinances to regulate, restrict, or prohibit any use or <br /> development in a11 or a part of the City while the City is considering adoption or amendments of the <br /> comprehensive plan or offcial zoning controls. The City declazes that this ordinance is established <br /> pursuant to the aforementioned statute and City ordinance. <br /> SECTION 2. �indings and Pumose. The City of Orono is conducting a <br /> comprehensive revision of its zoning code. One of the major goals of the revision is to minimize <br /> � land use conflicts near residential neighborhoods and to promote maintenance and reinvestment in <br /> commercial and industrial property. <br /> The City Council is concemed about the effects of adult uses in commercial and <br /> industrial districts neaz residential azeas, parks, and schools. The City Council is concerned that <br /> adult uses may contribute to instability through increased nighttime noise and traffic. <br /> , <br /> The City Council is concerned that adult uses aze not a service to the industrial and <br /> community level commercial districts. <br /> As a result of the important land use and zoning issues cited above,the City adopted <br /> an ordinance placing an interim moratorium on the granting of building pernuts, land subdivision, <br /> rezoning applications, conditional or special use pernuts, variances or other authority relating to <br /> adult uses in all commercial and industrial districts in the City of Orono. This moratorium is <br /> scheduled to expire on June 15, 1999. <br /> SECTION 3. Extension of Moratorium. Because the City has not completed its <br /> study and consideration of possible amendments to the comprehensive plan or official zoning <br /> controls to address the issues related to the establishment or expansion of adult uses,the moratorium <br /> relating to adult uses in all commercial and industrial districts in the City of Orono is hereby <br /> e�ended to November 12, 1999. <br /> Page 1 of 2 <br />
