� <br /> •.� ;� <br /> . <br /> ORDINANCE N0. 3 , 2ND SERIES <br /> AN ORDINANCE OF THE CITY OF ORONO, MINNESOTA, AMENDING ORONO CITY CODE <br /> CHAPTER 9 ENTITLED "PUBLIC PROTECTION, CRIMES AND OFFENSES" BY ADDING <br /> A PROVISION AS TO FIRE, BURGLARY AND SAFETY ALARMS; AND, BY ADOPTING <br /> BY REFERENCE, CITY CODE CHAPTER 1 AND SECTION 9.99 WHICH, AMONG OTHER <br /> THINGS, CONTAIN PENALTY PROVISIONS. <br /> THE CITY COUNCIL OF THE CITY OF ORONO ORDAINS: <br /> Section 1. Orono City Code Chapter 9 is hereby amended by adding <br /> a Section, to read: <br /> SEC. 9.35. FIRE, BURGLARY AND SAFETY ALARM REGULATIONS AND <br /> REQUIREMENTS. <br /> Subd. 1. Purpose and Scope. <br /> A. This Section provides for regulation in the <br /> use of fire, burglary, and safety alarms, establishes users' <br /> fees, and establishes a system of administration. <br /> B. The purpose of this Section is to protect the <br /> public safety services of the City from misuse of public safety <br /> alarms and to provide for the maximum possible service to public <br /> safety alarm users. <br /> Subd. 2. Definitions. The following terms, as used in <br /> this Section, shall have the meanings stated: <br /> l. "Public Safety Personnel" - City employees or <br /> employees duly authorized to maintain and enforce public safety. <br /> 2. "Alarm User" - The person in control of any <br /> building, structure, or facility wherein an alarm system is <br /> maintained. <br /> 3. "Alarm System" - Any alarm installation <br /> designed to be used for the prevention or detection of burglary, <br /> robbery or fire on the premises which contain an alarm installa- <br /> tion. Automobile alarm devices shall not be considered an alarm <br /> system under this Section. <br /> 4. "False Alarm" - An alarm signal eliciting a <br /> response by public safety personnel when a situation requiring a <br /> response does not, in fact, exist, and which false alarm is <br /> caused by the activation of the alarm system through mechanical <br /> failure, alarm malfunction, improper installation or the inadver- <br /> tence of the alarm system's owner or lessees or of his employees <br /> or agents. False alarms do not include alarms caused by climatic <br /> conditions such as tornadoes, thunderstorms, utility line <br /> mishaps, violent conditions of nature or any other conditions <br /> which are clearly beyond the control of the alarm manufacturer, <br /> installer or owner. <br /> -1- <br />
