FOR THE PQRPOSE OF THE ORDINANCE, A CONTROLL�D SUBSTANCE <br /> IS ANY SUBSTANCE LISTED I� THE FIVE SCHEDULES OF' CONTROI.LED <br /> SUBSTANCES IN MINNESOTA STA'TOTE 1986, SECTION 152.8. <br /> The City Council of the City of Orono ordains : <br /> SECTION. 9 . 57 . <br /> Controlled Substances, State Statute Incorporated . <br /> Controlled Substances Defined. <br /> Subd . l. The five ( 5) schedules of controlled <br /> substances listed in MN Statutes 1986, Section 152.P12, as <br /> amended, are hereby incorporated in and made a part of this <br /> section as if it set out herein in full for the purpose of this <br /> section, a controlled substance is any substance listed in the <br /> five schedules of controlled substances in MN Statutes 1986, <br /> Section 152.02. <br /> Subd. 2. Prohibited Acts. It shall be unlawful for <br /> any person to manufacture, possess, sell, give away, barter, <br /> exchange , distribute, or otherwise transfer any controlled <br /> substance, except on a lawful prescription by a person licensed <br /> by law to prescribe and administer controlled substances. <br /> Subd. 3. Possession Defined. Possession shall mean <br /> having the controlled substance in one's actual or constructive <br /> possession, including but not limited to having the controlled <br /> substance in any motor vehicle which is owned or operated by the <br /> person charged with possession. <br /> Subd. 4. Excepted Lawful Businesses and Professions. <br /> This ordinance shall not apply to the following in the ordinary <br /> course of their trade, their business , or their profession <br /> provided, however, this exception shall not be a defense to the <br /> doing of the acts prohibited in Prohibited Acts listed above <br /> hereof: <br /> A. Practitioners , persons licensed by law to <br /> prescribe and administer controlled substances. <br /> B. Pharmacists duly registered and licensed with <br /> the MN Board of Pharmacy. <br /> C. Manufacturers . <br /> D. Pharmacists and manufactureres . <br /> , <br />
