� , . <br /> ORDINANCE NUMBER 32, SECOND SERIES <br /> CHAPTER 4 <br /> INTOXICATING AND NON-INTOXICATING LIQUOR <br /> LICENSING AND REGDLATION <br /> SECTION 4.01. DEFINITIONS. As used in this Chapter, unless <br /> otherwise stated in specific sections, the following words and <br /> terms shall have the meanings stated: <br /> 1. "Applicant" means any person making an application <br /> for a license under this Chapter. <br /> 2. "Application" means a form with blanks or spaces <br /> thereon, to be filled in and completed by the applicant as his <br /> request for a license , furnished by the City and uniformly <br /> required . <br /> 3. "Club" means any corporation duly organized under the <br /> laws of this State for civic, fraternal , social, or business <br /> purposes or for intellectual improvement or for the promotion of <br /> sports, or a congressionally chartered veterans organization, which <br /> shall have more than fifty members , and shall , for more than a <br /> year, have owned, hired, or leased a building or space in a <br /> building of such extent and character as may be suitable and <br /> adequate for the reasonable and comfortable accommodation of its <br /> members, and whose affairs and management are conducted by a Board <br /> of Directors, Executive Committee, or other similar body chosen by <br /> the members at a meeting held for that purpose, none of whose <br /> members, officers, agents, or employees are paid directly or <br /> indirectly any compensation by way of profit for the distribution <br /> or sale of beverages to the members of the club, or to its guests, <br /> beyond the amount of such reasonable salary or wages as may be <br /> fixed and voted each year by the members or other governing body. <br /> Such club or congressionally chartered veterans organization must <br /> be incorporated and must have been in existence for at least three <br /> years . <br /> 4. "Financial Interest" includes any pecuniary interest <br /> in the ownership, operation, management or profits of a retail <br /> _ liquor establishment but does not include bonafide loans, bonafide <br /> rental agreements, bonafide open accounts or other obligations held <br /> with or without security arising out of the ordinary in the regular <br /> course of business of selling or leasing merchandise, fixtures or <br /> supplies to such a business or 10$ or less interest of any other <br /> corporation holding a license. <br /> 5. "Fraternal Club" means a club which serves only <br /> members and their guests and which uses any profits derived from <br /> liquor sales principally for sponsoring activities beneficial to <br /> the community and not for the profit of any individual. <br /> ORONO CC (4-1-84) <br /> 64 <br />
