� 103186 . 1 <br /> ORDINANCE NO. 13, SECOND SERIES <br /> AN ORDINANCE TBAT WOULD EXTEND THE MORATORIUM ON <br /> THE GRANTING OF BUILDING PERMITS, LAND <br /> SUBDIVISIONS, REZOINING APPLICATIONS, <br /> CONDITIONAL OR SPECIAL USE PERMITS, <br /> VARIANCES, OR OTHER AUTHORITY FOR <br /> ADDITIONAL DEVELOPI�IENT I�➢ THE HIG�WAY 12 <br /> CORRIDOR AREA AS DESCRIBED HEREIN. <br /> THE CITY OF ORONO ORDAINS : <br /> The Municipal Code of the City of Orono is amended by <br /> adding Ordinance No. �, Second Series: <br /> SECTION 1. Statement of Policy• The City Council <br /> continues to reevaluate its Comprehensive Plan, Zoning Ordinance, <br /> and other official controls, as they relate to the development of <br /> the Highway 12 Corridor. The Council finds that there is an <br /> overwhelming probability that land use controls and zoning <br /> provisions will need to be updated and revised as they apply to <br /> the Highway 12 Corridor Area. The Council also finds that such <br /> amending is a process that cannot be accomplished until a <br /> detailed study has been completed and hearing held. As the City <br /> has found it necessary to extend this moratorium, it is desirable <br /> that the Counci 1 continue to maintain guides for the benef it of <br /> those who wish to develop property in order to bring about <br /> savings in public and private expenditures and to provide to the <br /> public guides to future City action. <br /> The Council determines that there is an urgency involved because <br /> of the need to control development during the interim period so <br /> that the benefits of proper planning will not be lost, to prevent <br /> development which may add to the public burden, and to preserve <br /> the status quo pending adoption of these measures so that the <br /> City will not be impaired in its ability to effectuate the <br /> purposes and goals of these planning efforts . <br /> Since enactment of an amendment will undoubtedly modify existing <br /> regulations concerning permitted land use and zoning performance <br /> standards, the granting of various zoning and permit applications <br /> during this interium period would be detrimental to the <br /> effectuation of the Comprehensive Plan and contrary to the <br /> purp�se of the zoning enabling act, Minnesota Statutes SS462.351 <br /> et seq. <br /> The Council further finds that it would be unwise , improper and <br /> unjust to allow individual development to occur during this study <br /> period to avoid discrimination and unfair advantage to a few to <br /> the detriment of the entire City. Therefore, the Counci 1's and <br /> staff's authority to grant permits or approve applications <br /> decribed herein shall not be exercised during the limited term of <br /> this ordinance, except as provided in Section 6. <br /> i <br />
