MEMORANDUM <br /> Date: April 7, 2004 <br /> To: Tiffany w/Coldwell Banker Burnet f: (952) 475-9292 <br /> From: Janice Gundlach, City Planner , <br /> RE: In-ground Pool Restrictions for 521 North Stream Road <br /> After reviewing the survey on file for this property it is very unlikely that a pool can be <br /> constructed on this lot due to the following restrictions: <br /> • Lydiard Lake is considered a Natural Environment Lake which requires a 150' <br /> setback from the OHWL which is 970.9. The existing house is setback 155' from the <br /> 970.9' elevation. <br /> • A pool is considered an accessory structure and accessory structures cannot be <br /> located in the front yard. <br /> • Because the property is located in the Shoreland Overlay District the following <br /> hardcover restriction apply— starting at the 970.9' elevation: <br /> - 0-75' from the 970.9' elevation NO hardcover is allowed <br /> - 75-250' from the 970.9' elevation, 25% of the area in this zone can be <br /> hardcover <br /> - 250-500' from the 970.9' elevation, 30% hardcover is allowed and, <br /> - 500-1000' from the 970.9' elevation, 35% hardcover is allowed. <br /> The pool basin itself is counted as hardcover even though is it filled with water. <br /> • The following setbacks apply (depending on the size of the basin): <br /> o Side lot line— 10' if pool is 750 s.f. or less <br /> 15' if pool is 750-1000 s.f. <br /> 30' if pool is over 1000 s.f. <br /> Rear lot line— 150' from the OHWL of Lydiard Lake (970.9) <br /> As mentioned above it is virtually impossible to construct a pool on this lot meeting the <br /> 150' setback from the 970.9 elevation of Lydiard Lake.
