The garage is a legally non-conforming oversized accessory <br />structure. Additionally, the applicant proposes to construct an addition to the home which would result in a <br />separation of 9 feet from the garage where a 10 foot separation setback is required. <br /> <br />Planning Commission Recommendation <br />On August 15th the Planning Commission held a public hearing and reviewed the application including the <br />evidence submitted. Following the public hearing the Commission voted 4 to 0 on a motion to approve the <br />variances contingent upon the owners signing the oversized accessory structure covenants. <br /> <br />Planning Staff Recommendation <br />Staff recommends approval. A draft approval resolution has been provided for Council’s consideration which <br />incorporates the OAS covenants. <br /> <br />COUNCIL ACTION REQUESTED <br />Council should consider adopting or amending the approval resolution. <br /> <br />List of Exhibits: <br />Exhibit A.
