FILE #16-3839 <br />13 July 2016 <br />Page 5 of 6 <br /> <br />Septic System Status <br />The property is served by City sewer. <br /> <br />Practical Difficulties Statement <br />Applicant has completed the Practical Difficulties Documentation Form attached as Exhibit B, and <br />should be asked for additional testimony regarding the application. <br /> <br />Practical Difficulties Analysis <br />Staff finds the requested variance to encroach into the 75-foot lakeshore setback is minimal; the <br />applicant is unable to construct any additions to the home without variances from the lake <br />setback. Although the requested hardcover variances within the 0-75 foot zone and on the Tier <br />1 property as a whole result in no net increase in hardcover for the property, staff would <br />encourage the applicant to further limit the proposed hardcover. The distance between Ferndale <br />Road and the home necessitate a specific minimal length of driveway however the proposed <br />driveway which includes a considerable loop may not be supported by practical difficulties. The <br />driveway replacement does result in a reduction in driveway hardcover however this is offset by <br />the structural addition over the driveway near the home. Staff suggests reductions could be made <br />to the proposed driveway in conjunction with some mitigating measures to encourage infiltration <br />– such as raingardens, permeable pavement, etc. <br /> <br />Staff finds the proposed side setback variance is reasonable considering the orientation of the <br />home, and the resulting 10 foot setback allowing for adequate open space between the garage <br />and the home to the east. <br /> <br />Engineer Comments <br />The City engineer has conducted a cursory review of the applicant’s plan; no issues were noted. <br />A comprehensive review will be done at the time of the building permit. <br /> <br />Public Comments <br />As of the drafting of this memo, no comments from the public have been received. <br /> <br />Issues for Consideration <br /> <br />1. Does the Planning Commission find that that the property owner proposes to use the <br />property in a reasonable manner which is not permitted by an official control? <br />2. Does the Planning Commission find that the variances, if granted, will not alter the <br />essential character of the neighborhood? <br />3. Does the Commission find it necessary to impose conditions in order to mitigate the <br />impacts created by the gra nting of the requested variance s? <br />4. Are there any other issues or concerns with this application? <br /> <br />Planning Commission Options for Consideration <br />The Planning Commission may consider the following alternative motions: <br />1. Approval of the hardcover, lake setback, and side setback variances as requested; or <br />2. Approval of the lake setback and side setback variances. Approval of hardcover variances <br />resulting in a specified net reduction in hardcover and/or in conjunction with stormwater <br />management BMPs implemented on site; or <br />3. Denial of the variances as requested.
