<br />Page 1 of 19 <br />Draft #3 – 7/21/16 <br />A RESOLUTION APPROVING THE <br />GENERAL CONCEPT PLAN <br />AND GRANTING PRELIMINARY PLAT APPROVAL <br />FOR PROPERTY LOCATED AT <br />3245 WAYZATA BOULEVARD WEST <br />- FILE NO. 16-3822 <br /> <br />WHEREAS, Lakewest, LLC, a Minnesota limited liability company (hereinafter <br />the "Developer") is owner of the property located at 3245 Wayzata Boulevard West within the <br />City of Orono (hereinafter the "City") and legally described as follows: <br /> <br />Exhibit A (attached) <br />(hereinafter the "Property"); and <br /> <br />WHEREAS, the Developer has requested General Concept Plan and Preliminary <br />Plat Approval for development of the Property. Proposed is a rezoning from RR-1B, One Family <br />Rural Residential District to RPUD Residential Planned Unit Development District for <br />construction of 27 single-family homes; and <br /> <br />WHEREAS, the Developer has concurrently requested an amendment of the 2008- <br />2030 Orono Community Management Plan (“CMP”) to allow said development at a density of <br />approximately 5.5 dwelling units per acre, rather than the 10-15 units per acre for which the <br />Property is guided in the CMP; and <br /> <br />WHEREAS, on April 4, 2016 the Developer filed a complete formal application <br />with the City for Comprehensive Plan amendment, rezoning, and concept plan & preliminary plat <br />approval for a 27-lot residential subdivision of the Property; and <br /> <br />WHEREAS, after due published and mailed notice in accordance with Minnesota <br />Statutes 462.358 et. seq. and the City of Orono Zoning and Subdivision Codes, the Orono Planning <br />Commission held a public hearing for the application and reviewed it on April 18, 2016, at which <br />time all persons desiring to be heard concerning this application were given the opportunity to <br />speak thereon; and <br /> <br />WHEREAS, the Planning Commission on April 18, 2016 recommended on a vote <br />of 4-1 that the Council grant the proposed Comprehensive Plan Amendment; on a vote of 5-0 that <br />the Council approve the rezoning to RPUD Residential Planned Unit Development District; and <br />on a vote of 5-0 that the Council grant general concept plan and preliminary plat approval subject <br />to a number of conditions and recommendations; and <br />
