Gaffron JML Planning Dept. <br />Title: Senior Planner <br />______________________________________________________________________________ <br />Item Description: #15-3723 Source Land Capital, Lakeview of Orono <br />- Release Outlot C from Development Contract – Authorize Agreement <br />______________________________________________________________________________ <br /> <br />List of Exhibits <br /> A – Proposed Release Agreement <br /> B – Development contract, Section 24H <br /> C – Plat Drawing <br /> D – Air photo <br /> <br />Outlot C of Lakeview of Orono is a parcel of approximately 2.0 acres that was part of the overall <br />development property but was intended for re-transfer to Grant Wenkstern, whose homestead is <br />on the adjacent property to the south at 710 North Shore Drive West. Outlot C contains a former <br />golf course maintenance and storage building. <br /> <br />The Outlot was not intended as a Lakeview of Orono building site. It was not tested for on-site <br />sewage treatment, was not provided with access to any of the private roads, does not contain any <br />preservation easement areas, was not charged a park fee, and is simply intended as adjacent land <br />to Wenkstern’s homestead. <br /> <br />As such, the only part of the Development Contract pertinent to Outlot C is Section 24H <br />(attached) which requires that it be re-platted as a Lot (rather than as an Outlot) if at some future <br />time it is planned to be used as a residential building site. The Developer has requested that <br />Outlot C be released from all aspects of the development Contract save for Section 24H. Staff <br />concurs. The attached Agreement accomplishes that release. <br /> <br />COUNCIL ACTION REQUESTED <br />Consider a motion to authorize Mayor and City Administrator to execute the attached Agreement <br />releasing Outlot C of Lakeview of Orono from all provisions of the Development Contract <br />except for the first two sentences of Section 24H.
