<br /> <br /> REQUEST FOR COUNCIL ACTION <br /> <br />DATE: June 13, 2016 <br />ITEM NO: 14 <br />Department Approval: Administrator Reviewed: Agenda Section: <br />Name Jeremy Barnhart JML Planning <br />Title Community Development Director <br />Item Description: #16-3824, City of Orono Text Amendment: Subdivision Exception <br />Application Summary <br />By definition in either City Code or the State Statute, the adjustment of a lot line by relocation of a <br />common boundary is not a subdivision, though we process these in a manner similar to a subdivision <br />(Planning Commission, Council meeting, approval by resolution). This issue was number 6 in priority <br />from last fall’s review of the city code. <br /> <br />To be consistent to City Ordinance and State Statute, Staff will process lot line arrangements internally, <br />if both lots meet the size and area requirements, and no non-conforming situation is created. The <br />proposed ordinance established that process. <br /> <br />Where one or both resulting lots do not meet the requirements, or other non-conformities are created a <br />variance (for lot area/ width, setback, or hardcover, e.g.) would need to be processed prior to staff <br />certifying the lot line arrangement. <br /> <br />Planning Commission Recommendation <br />The Planning Commission held a public hearing on May 16th. The Planning Commission recommended <br />approval of the ordinance as drafted. No public comments have been received for or against the <br />proposed ordinance. <br /> <br />Action Requested: <br />By motion, approve the ordinance as drafted. <br /> <br />List of Exhibits: <br />Exhibit A.
