<br /> Sec.13.04 RIGFiTS OF SUB.TECTS OF DATA
<br /> Subd. 1. Type oP data. The righGs of individual on whom the data is stored or w be siored shall be as set forth in tfus section.
<br /> Subd.2. Information required to be given individual. An individual asked to supply private or confidenda2 dara conceming himself shall
<br /> be infotmed of: (a)the purpose and intended use of the requested data within the collecang§rate agency,political subdivision,or statewide system;
<br /> (b)whether he may refuse or is legally required to supgiy the requested data;(c)any Imown consequence arising from his supglyiag or refusing to supply
<br /> privaie or confidenaal data;and(d)rhe idendty of othec persons or entides authorized by state or federa!law to receive the data. Tfris requirement shall
<br /> not aQply when an individual is asked to suppiy invesugaava data,pursuanc to secdon 13.82, subdivision 5, to a law enforcement o�cer.
<br /> The commissioner of revenue mav olace the nodce required under this subdivision in che individual income rax or prooercv tax refund
<br /> instructions instead of on those forms.
<br /> Subd.3. Access to data by individual. Upon request to a responsible authoriry,an individual shall be informed whether he is the subject
<br /> of stored data on i�dividuals,and whether it is classified as public,private or confidendal. Upon his furthec request,an individual who is the subjecc
<br /> of stored private or pubtic data on individuals shall be shown the data without any charge to him and, if he desires, shall be informed of the content
<br /> and meaning of that data..After an individual has been shown the private data and informed of iu meaning,the data need not be disclosed to him for
<br /> six months itiereafter unless a dispute or acrion purs�.uit w this secrion is pending or addidonal data on the individual has been collected or creaced.
<br /> The responsible authority shall provide copies of the private or public data upon request by the individual subject of the data. The responsible authoriry
<br /> may require the requestin�person to pay the acuial cosu of making,certifying, and compilin;the copies.
<br /> The responsible authoriry shall compiy immediately,if possible,with any request made pursuant to this subdivision, or wirhin five days of
<br /> the date of the requesc,exctudin�Saturdays,Sundays and Iegal holidays,if immediate compliance is not possible. If he cannot comply with the requesc
<br /> within that time,he shail so inform the individuai,and may have an additional five days wirhin which to comply with the request,excluding 3atardays,
<br /> 5undays and legal holidays. ' .
<br /> Subd.4. Procedure when data is not accurate or compiete. An individuat may contest the accuracy or compieteness of public or private
<br /> data concerning himself. To exercise chis right,an individual shall notify in writing the responsible au�horiry dzscribing the nature of die disagreemeat.
<br /> The responsible authoriry shall within 30 days either: (a)correct the data found to be inaccurace or incomplete and attempt to notify past recipients of
<br /> inaccarace or incomplece data, includin; recipients named by the individual; or(b)notify the individual that he believes the data to be correct. Data
<br /> in dispute shall be disclosed only if the individual's statement of disagreement is included wich the disdosed data.
<br /> The detarmination of che resgonsible authoriry may be appealed pursuant to the provisions of the administncive procedure acc relaring co
