The Orono Plaruung Commission reviewed this application on June 16, 1997 and <br /> recommended unanimous approval of the proposed variances based upon the <br /> following unique findings and hardships: <br /> A. The zoning lot conforms to lot area and yard requirements. <br /> B. The existing residence is partially located forward of the average <br /> lakeshore setback. <br /> C. The applicants have removed plastic under the landscaping and existing <br /> hardcover is less than previously approved for the variance to allow the <br /> pool. (File No. 1574, Resolution No. 2860). <br /> D. The proposed addition to the garage will not impact lake views for <br /> adj acent property. <br /> 4. The City Council finds that the conditions existing on this property are peculiar <br /> to it and do not apply generally to other property in this zoning district; that <br /> granting the variance would not adversely affect traffic conditions, light, air nor <br /> pose a fire hazard or other danger to neighboring property; would not merely <br /> serve as a convenience to the applicants, but is necessary to alleviate a <br /> demonstrable hardship or difficulty; is necessary to preserve a substantial <br /> property right of the applicants; and would be in keeping with the spirit and <br /> intent of the Zoning Code and Comprehensive Plan of the City. <br /> 5. The City Council has considered this application including the findings and <br /> recommendations of the Planning Commission, reports by City staff, comments <br /> by the applicants and the effect of the proposed variance on the health, safety <br /> and welfare of the community. <br /> CONCLUSIQNS, OR�ER AND COT�TDITIONS <br /> Based upon one or more of the follo��ing above findings, the Orono City Council <br /> hereby grants an average lakeshore setback to allow a 6' addition to the lake side of the <br /> existing garage and a hardcover variance to a.ilow no more than 35.6% (10,348.92 sq. ft.) where <br /> Page 2 of 4 <br />
