The City Cou,�cil has considered this application <br /> including the findings and recommendations of the Planning <br /> Commission, reports by City staff, comments by the applicant <br /> and the effect of the proposed variance on the health, safety <br /> and welfare of the community. The City Council finds that the conditions existing on � <br /> �his proYerty arQ pecnliar ta�t and do not apply general3y to <br /> other property in this zoning distzict; that grantir.c; the <br /> variance would not adversely affect traffic conditions, <br /> light, air nor pose a fire hazard or other danger to � <br /> j neighboring property; would not merely serve as a � <br /> convenience to the applicant, but is necessary to alleviate a <br /> demonstrable hardship or difficulty; is necessary to <br /> preserve a substantial property right of the applicant; and <br /> would be in keeping with the spirit and intent of the Zoning <br /> Code and Comprehensive Plan of the City. <br /> CONCLUSIONS, ORDER AND CONDITIONS <br /> Based upon the above findings, the Orono City Council hereby <br /> grants a variance to the Municipal Zoning Code Section I0.22, <br /> t Subdivision 2 to permit the constzuction of a deck which will increase <br /> hardcover in the 75-250' setback zone from 6,898 square feet (or 248) to <br /> 8,044 square feet or (298) whe��: only 7,018 square feet t258) is <br /> allowed, subject to the following conditions: <br /> 1. The hardcover allowed by this variance is in excess of <br /> �� '=# D� �;,�; the 25 percent allowed in the 75-250' foot setback zone. The <br /> �-�r.-; ,�'� ';.,;, apolicant is hereby advised that the City will not apptove <br /> �'� -� iu�`�r any f uture improvements that result in ac'ditional <br /> �� + s� * �, � �i hardcover, and that i£ such improvements are proposed, that <br /> �`�� "��'�''~ they bA cour,terbalanced with the removal of existinq <br /> #:.
