In <br />the 1970s or 1960s, the adjacent property owner had installed the drain tile and it has since deteriorated <br />and collapsed. Anderson stated for the last two springs, it has been very wet and the water level has been <br />increasing. <br /> <br />Levang asked if it is correct that the original conditional use permit was for 10,000 cubic yards and now it <br />will be closer to 20,000 cubic yards. <br /> <br />Curtis indicated that is correct. <br /> <br />Anderson stated that is because the pasture area has doubled in size. <br /> <br />David Bade, Westwood Professional Services, stated he has been retained by the Hedbergs to provide an <br />independent third party analysis on some of the compliance issues and some of the activities that have <br />been happening since this project started. Bade noted he has prepared a memo that was submitted to the <br />City earlier today. <br /> <br />Bade stated the main concerns are the potential impacts to the Hedberg property based on the grading <br />activities, specifically the extent of the grading in the outflow area. Bade stated the proposed grading <br />plan may potentially impact the low lying areas and that there are structures in fairly close proximity to <br />the wetlands. Bade indicated he will need more information to complete a drainage analysis to determine <br />what has been done to the drain tile. <br /> <br />McMillan asked if the Hedbergs have ever had the wetland delineated on their property. <br /> <br />Bade stated he does not believe there is a wetland on their property. <br /> <br />McMillan stated since the City Council just received his memorandum tonight, it may be necessary for <br />the City Council to take it under advisement. <br /> <br />Bade stated the main concern at this point in time is the expansion of the project and the berm. Bade <br />stated those areas will provide less overall capacity in the low lying area and that the concern during large <br />storm events is where the water will go. Bade stated based on the plan, in his view the likely path of the <br />drainage could impact the Hedberg’s property. <br /> <br />Anderson stated the yellow area is where some of the recovered top soil is stockpiled. The elevation in <br />that area is supposed to go back to the original elevation. Anderson stated the area where there are no <br />lines in the delineated area, all of that will drain now because the drain tile has been fixed, and that there <br />should not be overflow occurring onto the other property. <br /> <br />Bade stated they would request an actual drainage analysis be performed by a licensed professional <br />engineer. Bade noted this proposed grading plan has come out just within the last few days and that they <br />do not know what the impact will be in the spring.
