VOTE: Ayes 4, Nays 0. <br /> <br /> <br />*6. #14-3688 APPLIED ECOLOGICAL SERVICES, 520, 550 AND 630 TONKAWA ROAD – <br />CONDITIONAL USE PERMIT/WETLAND ALTERATION – RESOLUTION NO. 6451 <br /> <br />Bremer moved, Printup seconded, to adopt RESOLUTION NO. 6451, a Resolution Granting a <br />Conditional Use Permit Pursuant to Municipal Zoning Code Section 8-967 and 78-1610, for the <br />property located at 520, 550, and 630 Tonkawa Road. VOTE: Ayes 4, Nays 0. <br /> <br /> <br />7. #14-3689 SVEN GUSTAFSON, 2490 CARMAN STREET – VARIANCE – RESOLUTION <br />WAS APPROVED BUT TABLED FOR CHANGES <br /> <br />Curtis stated the property is located in the LR-1B zoning district and abuts an undeveloped 30-foot street <br />right-of-way or fire lane. The right-of-way is considered a side street for the purpose of measuring <br />setbacks and a 35-foot setback is required. The neighboring property on the west side of the right-of-way <br />is within the one-half acre zone and is subject to a 15-foot setback. <br /> <br />The applicant is requesting a setback variance to permit a 15-foot setback where a 35-foot setback is <br />required in conjunction with the construction of a new residence. The lot line rearrangement approval <br />granted to this property and the property to the east was conditioned upon the property owner providing <br />an easement to the property to the east. The driveway easement and lot line rearrangement resolution <br />have been recorded. <br /> <br />On September 15, the Planning Commission voted 7-0 to recommend approval of the requested setback <br />variance. During the public hearing there was a question raised regarding the location of trees located <br />along the common lot line. The applicant has provided a survey showing the trees are located on their <br />property and not within the right-of-way. The trees are also located outside of the 0-75 foot zone. <br /> <br />
