The proposed garage is considered an oversized accessory
structure. The setback variance is required as the proposal is not an in-kind rebuild and it is between the
house and the street where an accessory building is required to be located behind the front plane of the
house.

Curtis noted at the February meeting, the Planning Commission voted 5-0 to recommend approval of the
setback variance allowing the oversized garage.

Curtis stated that staff recommends approval of the setback variance to allow a new garage to be
constructed in the proposed location. The applicants should be required to submit hardcover calculations
with the building permit ensuring that hardcover will be in compliance. The owners will also need to sign
an oversized accessory structure covenant prior to the issuance of a building permit. Staff has prepared a
resolution for approval by the City Council.

Levang asked why the new structure is not being put next to the house.
