The property owner made changes to the approved site plari, and City Council <br /> approved the revised plan on February 11, 2002. <br /> �. This resolution supersedes Resolution No. 4695. <br /> 6. The City Council finds that the conditions existing on this property are peculiar to it <br /> and do not apply generally to other property in this zoning district; that granting the <br /> variance will not adversely affect traffic conditions, light, air, nor pose a fire hazard <br /> or other danger to neighboring property;would not merely serve as a convenience to <br /> the applicants, but is necessary to alleviate a demonstrable hardship or difficulty; is <br /> necessary to preserve a substantial property right of the applicant; and would be in <br /> keeping with the spirit and intent of the Zoning Code and Comprehensive Plan of the <br /> City. <br /> 7. The City Council has considered this application including the findings and <br /> recommendations of the Planning Commission, reports by City Staff, comments by <br /> the applicants and the effect of the proposed variance on the health, safety and <br /> �velfare of the community. <br /> CONCLUSIONS, ORDER, AND CONDITIONS <br /> Based upon one or more of the above findings, the Orono City Council hereby grants a <br /> �•ariance to Municipal Zoning Code Section 10.56, Subdivision 16(C)(1)to permit structure within <br /> 150' of a Natural Environment Lake, Section 10.56, Subdivision 16(L)(1) to permit 3,830.2� s.f. <br /> (23.5%)of hardcover in 0-75'setback area where 4,381 s.f. (26.9%)e�cists and 0 s.f.(0%)is allowed <br /> and Section 10.56, Subdivision 16(C)(6)to permit the encroachment of 50'and 75' into the average <br /> lakeshore setback for construction of a three stall garage to the east end of the residence, a new <br /> entry�vay over existing steps and a cantilevered bay window. Approval is subject to the following <br /> conditions: <br /> 1. Council approval is based on the site plan submitted by the applicants attached to this <br /> resolution as Exhibit A. Any amendments to the site plan may require further <br /> Planning Commission and City Council review: <br /> 2.
